Terms of Use

Your use of the Streamintickets web sites and the purchase of tickets, goods, or services from these web sites constitute your agreement to, and that your activities are governed by, these terms and conditions.

Streamintickets acts as the agent to those who are promoting or otherwise providing the items and/or events which you are purchasing, such as venues, event promoters, artists' representatives, teams and leagues ("Event Providers"). Streamintickets acts only as a service provider providing the technologies and tools to facilitate web-based sales and is not a party to any agreements or obligations between the Event Provider and the purchaser. The Event Provider, and the purchaser, are the only parties entering into an agreement regarding items and/or events and their sale. It is the Event Providers’ duty to advise and instruct purchasers as to the terms and conditions and of any eventually existing legal obligations between those parties. Each ticket or product that you purchase is subject to the additional terms set forth by the Event Provider.

Currency
The currency to be used for ticket prices will be identified on the website. Events stating USD$ will be in U.S. Dollars and events stating CAD$ will be in Canadian Dollars.

Order Confirmation
If you do not receive an order confirmation (in the form of a confirmation page or email) after submitting payment information, or if you experience an error message or service interruption after submitting payment information, it is your responsibility to confirm with the Event Provider or Streamintickets whether or not your order has been placed. Only you may be aware of any problems that may occur during the purchase process. Streamintickets will not be responsible for losses (monetary or otherwise) if you assume that an order was not placed because you failed to receive confirmation. Pricing & Availability
Streamintickets facilitates the sale of items and/or events on behalf of Event Providers and we therefore do not set nor control pricing, inventories or availability. On Sale dates, ticket limits and any and all other such restrictions imposed by the web site are set and administered by the Event Provider.

Convenience Charges and Order Processing Fees
Tickets purchased on the Streamintickets web sites are typically subject to a per ticket service charge and a per order processing fee. Such fees and charges are non-refundable even in the event the price of tickets and/or products purchased are refunded by the Event Provider for any reason.

Refunds and Exchanges
No refunds or exchanges are permitted. Before completing the purchase, carefully review your order. Our agreement with the Event Providers prohibits Streamintickets from issuing exchanges or refunds after a purchase has been completed. You agree that you will not attempt to evade, avoid, or circumvent those prohibitions in any manner with regard to tickets you purchased. Without limiting the generality of the foregoing, you will not contact Streamintickets to seek a refund or exchange from us and you will not dispute or otherwise seek a "chargeback" from the company whose credit card you used to purchase tickets from the Site. Should you do so, your order may be cancelled, and we may, in our sole discretion, refuse to honour pending and future ticket purchases made from all credit card accounts or online accounts on which such chargebacks have been made, and may prohibit all persons in whose name the credit card accounts exist and any person who accesses any associated online account or credit card or who otherwise breaches this provision from using the site. In the event you believe a refund or exchange is due, such remedy is to be pursued directly with the Event Provider.

Pricing and Other Errors
If the amount you pay for an item or event is incorrect regardless of whether because of an error in a price posted on this web site or otherwise communicated to you, or you are able to order an item before its scheduled on-sale or presale date or you are able to order an item that was not supposed to have been released for sale, then: Streamintickets will have the right to cancel that item (or the order for that item) and refund to you the amount that you paid. This will apply regardless of whether because of human error or a transactional malfunction of this web site or other Streamintickets operated system.

Limitation of Liability
You assume all risks incidental to any event for which a ticket is issued, whether before, during or after play or performance, and you waive any claims for personal injury or death against Streamintickets on behalf of yourself and any accompanying minor.

Exclusions
The information on this web site is provided on an “as is” basis. To the fullest extent permitted by law, Streamintickets:
•    excludes all representations and warranties relating to this web site and its contents or which is or may be provided by any affiliates or any other third party, including in relation to any inaccuracies or omissions in this web site and/or the Company’s literature; and
•    excludes all liability for damages arising out of or in connection with your use of this web site. This includes, without limitation, direct loss, loss of business or profits (whether or not the loss of such profits was foreseeable, arose in the normal course of things or you have advised us of the possibility of such potential loss), damage caused to your computer, computer software, systems and programs and the data thereon or any other direct or indirect, consequential and incidental damages.

You may not create a link to any page of these web sites without our prior written consent. If you do create a link to a page of this web site you do so at your own risk and the exclusions set out above will apply to your use of this web site by linking to it.

Opinions expressed or material appearing on such web sites are not necessarily shared or endorsed by us and we should not be regarded as the publisher of such opinions or material. Please be aware that we are not responsible for the privacy practices, or content, of these sites. We encourage users to read the privacy statements of these sites. You should evaluate the security and trustworthiness of any other site connected to the site or accessed through these sites yourself, before disclosing any personal information to them. Streamintickets will not accept any responsibility for any loss or damage in whatever manner, howsoever caused, resulting from your disclosure to third parties of personal information.

Prohibited Use

Misuse
If Streamintickets suspects that the content or usage of an event providers’ web sites is inappropriate, for any reason, at the sole discretion of Streamintickets, the event providers’ web site(s) can be deactivated without notice.

Limitation of Liability / Exclusions
Streamintickets assumes no risks incidental to any sale and/or event, whether before, during or after, and you waive any claims for personal injury or death against Streamintickets.

The accuracy and completeness of the information on the client web site is the sole responsibility of the event provider . The event provider warrants that to the best of their knowledge and understanding, the content of the web sites is complete, accurate and lawful.

Indemnity
You agree to indemnify, defend and hold harmless Streamintickets and its respective agents, directors, officers, employees and licensors, and all other related, associated, or connected persons (collectively, the "Indemnified Parties") from and against any and all liabilities, expenses and costs, including without limitation reasonable legal fees and expenses, incurred by the Indemnified Parties in connection with any claim or demand arising out of, related to, or connected with the use of Streamintickets web sites by you or your breach of this agreement. You will assist and co-operate as fully as reasonably required by the Indemnified Parties in the defence of any such claim or demand.

Force Majeure
Neither party shall be liable to the other for any failure to perform any obligation under any Agreement which is due to an event beyond the control of such party including but not limited to any Act of God, terrorism, war, Political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or man made eventuality outside of our control, which causes the termination of an agreement or contract entered into, nor which could have been reasonably foreseen. Any Party affected by such event shall forthwith inform the other Party of the same and shall use all reasonable endeavours to comply with the terms and conditions of any Agreement contained herein.

Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. You hereby expressly consent to the sole and exclusive jurisdiction and venue of the courts of the Province of Ontario, located in the city of Toronto for any legal proceeding arising out of or relating to your use of Streamintickets web sites or these Terms.

Notification of Changes
Streamintickets reserves the right to change these conditions from time to time as it sees fit and your continued use of our services and web site(s) will signify your acceptance of any adjustment to these terms.
